Americas Servicing Company complaint

We send checks, they send them back...late fees. We send bank checks, they send them back...late fees.

We send money order, the send them back....late fees.

We have them take it out of our account. They say money isn't in there (and it certainly is)....late fees.

In other words. They rip up our checks to install late fees then give us bad credit reports because of it which causes us to not be able to refinance as a bank sees it as delinquent. This is EXACTLY what they want!!!! Don't you all get this. They are against the United States Constitution and their ethics are ignorant as a company. They have stupid Customer Service reps, you never get the same person to speak with, they do not document your information correctly no matter how many times your on hold for hours at time explaining things to them. They have so many irrelevant departments they say they need to send you to. It's a joke. This company should be audited by the Attorney General's office. They think that because we mortgage holders live in other states that we can't do anything about it. Well...watch me!

Oh yeah, when your mortgage is due...go directly to your bank and pay $20 to wire the money to them. Get the wiring account number from ASC (if you can) and each month go into the bank and do it!! This is the only way I will ever pay them another dime. It is documented through the bank and if there is any problem YOUR bank will let you know. Hasn't been one problem since I have taken this step. You have to pay to do it on THEIR website so why not be very careful and do it the right way. AT YOUR BANK OR LOCAL BANK!! They are crooks from the word go!!!

i have been having a lot of trouble with A.S.C i lost my job, was 1 mo. behind. i payed them the next mouth and every mouth after that. they now are saying i am 7 mo. behind which is not true. they are forclosing on my home. they need to be stoped, i dont have the money to fight tham any more. so everyone be carful .

im the one where my wife signed my name to loan with asc im worn out every body i have no more money im working just to save my house from them i can't do it i can't aford help no one wants to help unless you have MONEY look for me on the freeway thats where my new place to live is p,s kathy my once trusted wife "carma" its gunna get cha

MORTGAGE SERVICING FRAUD and ASC is one of the worst around. Please visit http://www.msfraud.org/forum.htm for some advise how to deal with these morons

We have had similar experieces as the ones listed on this site. Three months of payments not cashed by ASC - in December they said they never got them, two weeks later they said they got them and "accidentally" returned them to us - we never got them back. Then they say we owe $6,500, but they won't accept a personal check - we put the money in bank checks and money orders and sent them. Meantime they try cashing the checks that they never applied to our account and they said they never got, then got and returned to us. Now all our money is in bank checks and money orders and we get paper work to show up at court so they can foreclose. I called their law office and they stated, yes, they got the payments but returned them to us. We again, never got them back. All through January we waited. Finally about two weeks ago, we got the money orders and bank checks back less $1,000 with a letter stating that we did not send enough money. The letter was dated Feb 1 - the checks were stamped returned Jan 14th - where were these checks in the mean time and where is the additional money we sent???

Now we have to go to court in March to defend our position and their refusal to take our money. A few days ago, we received a letter that the servicing of our loan has been sold!! Now what?? Who are we supposed to be facing in court now? the new company that has no idea what has been going on? This isn't the first time this has happened with them. I was made to feel like it was my fault the last time they did this to us and I didn't keep good records of our payments with them - but this time - I kept everything!! We had to file for bankruptcy the last time they did this to stop the foreclosure on our home. We make more than enough to pay them and our other bills if they would just accept the payments and stop screwing with them. I hope that the judge will see that we have proof they have mis-accounted for payments, returned (or not returned) payments when they should have accepted them and we will find a solution that keeps us in our home and our payments go back to normal.
