We have had similar experieces as the ones listed on this site. Three months of payments not cashed by ASC - in December they said they never got them, two weeks later they said they got them and "accidentally" returned them to us - we never got them back. Then they say we owe $6,500, but they won't accept a personal check - we put the money in bank checks and money orders and sent them. Meantime they try cashing the checks that they never applied to our account and they said they never got, then got and returned to us. Now all our money is in bank checks and money orders and we get paper work to show up at court so they can foreclose. I called their law office and they stated, yes, they got the payments but returned them to us. We again, never got them back. All through January we waited. Finally about two weeks ago, we got the money orders and bank checks back less $1,000 with a letter stating that we did not send enough money. The letter was dated Feb 1 - the checks were stamped returned Jan 14th - where were these checks in the mean time and where is the additional money we sent???
Now we have to go to court in March to defend our position and their refusal to take our money. A few days ago, we received a letter that the servicing of our loan has been sold!! Now what?? Who are we supposed to be facing in court now? the new company that has no idea what has been going on? This isn't the first time this has happened with them. I was made to feel like it was my fault the last time they did this to us and I didn't keep good records of our payments with them - but this time - I kept everything!! We had to file for bankruptcy the last time they did this to stop the foreclosure on our home. We make more than enough to pay them and our other bills if they would just accept the payments and stop screwing with them. I hope that the judge will see that we have proof they have mis-accounted for payments, returned (or not returned) payments when they should have accepted them and we will find a solution that keeps us in our home and our payments go back to normal.
