My nightmare began when I began the loss mitigation process in the beginning I as hopeful maybe a little naive. I sent the application and waited a few days

When I called back they stated they had never received. Keep in mind it was the loss mitigation fax line. The Black Hole. So anyways months went my phone calls continued to the Loss Mitigation department. I was told to mail in 5,000 to show that in good faith I was wanting this. Then I received an agreement package that I had to get notarized . I did in it was stated that O had a payment plan and i had to stick with it. I mad my first payment no problem the following month I attempted to make a payment and the transferred me to Carol Brown my negotiator. She stated that I could not make another payment until the Loss Mitigation was finalized. I told her I thought the agreement they sent me meant it was finalized she stated it was not. It would not be finalized until I began receiving statements showing no negative balanced owed. She stated it would be like starting fresh. In the beginning of December I was told that the Loss mitigation was finally approved by the investors. I waited for paperwork in never came . I finally contacted the supervisor Dorothy Rettig she stated the same thing not to worry . The last week Mrs. Brown called me stating that I would receive the final agreement to be signed and that I had 5 days to return. I did get the packet but it belonged to another ASC borrower Carlos Garnica in Washington state. I called and called left messages.

on 1/23 I had a call from the Supervisor she stated that my Loan was in active default because i never made a payment as agreed for the first agreement. I thought is was a joke had called several times to make a payment and they would never take it. She had never mentioned it ever in any of the conversations we had the past months. I had told her evem she had stated I had to wait to get it finalized.

I felt it was a set up or cover up for something they botched. She stated now I had to call the collection department make payment arrangements and she would call the Attorney to stop foreclosure proceedings. I called the collections department they stated they needed to call Dorothy Rettig I never heard back form them. This morning I received a call and the rep had no notes from 1/23 the conference call Mrs. Rettig and Mrs. Brown made to me . She suggested I call Loss Mitigation again on Monday. I am at a loss she stated I needed to pay 19,000 to avoid foreclosure proceedings. I need help this is not a fraud it's a plea for help from anyone.

If anyone can help financially or your an Attorney please help me . This company should not be allowed to do this to anyone.

I received my final loan modifications documents today. I called DHL and they are picking up today as well.  

We signed all the document and if all goes well my situation is resolved.

Wow, guess those two can't read.  

Anyway, we're going threw the same thing. We applied in about Sept 07, now we've compleeted our temporary forbearance, and they requested over $7000 from us within 5 days (actully 4 days because day 5 falls on Sunday). Noone ever mentioned a huge payment like that. We had no idea that was comming, plus, we've been paying $700 more a month threw the forbearance! Guess we're going back into forclosure (they put us there the first time waiting for the forebarance to be written up, by refusing payments for 3 months)!

I was contacted today from ASC and was given a reasonable new payment 

that I can afford. I just need to sign my paperwork. 

I will keep you posted.

I am in AWE! I thought I was the only one dealing with this, I am just shocked,numb and at a loss!

I got back in my payment March 2007. I contacted ASC and made payment arrangements of $835.00 due on the 31st of each month. My last payment was schedule for October of 2007 and I was going to be back on track. August 2007 I sent my payment off on the 10 of August. ASC claim they never got my payment until September. I forward them the cerfied that they sign on August 20. They put me back on a repayment plan of $980.00. They going claim they never recieve the payment. NOW! they want me to pay $1,300.00. DAM THAT!!! They can have the house.

ASC has done it again! I was working towards loan modification since July 2007. In July I made a "good faith" payment of $3,500 and agreed to make six monthly payments of $900 each . I made every payment (on time). When I made the last payment (in Jan), the woman I spoke with, told me that I would have to recalculate my financial information to set my new payment amounts. At that time, I told her that nothing had changed and all the info was the same. The woman laughed and said that I was just about done with everything. Well, I never got any information from them the entire month of Feb (they were supposed to tell me my new payment amounts). I waited and waited, then on March 4th, I get a letter saying that I failed to adhere to the terms of the payment plan (I don't know what terms they are talking about). When I called them, I was told that since I didn't call to recalculate my financial info, I was removed from the payment plan. At that time, the rep did a new financial calculation and offered me a NEW long mod where I would put $4000 down and make six payments of $1,071.00! I even called on 3-way with a representative from HOPE and they wouldn't assist me in any way. They were adamant that that is the only option I had. Then, the rep said that IF I would have completed the payment plan, my payments would have been $648! Talk about pouring salt in the wounds!!! Tomorrow, I have an appointment with an attorney and hopefully he can assist me with this. This company is the worse I have ever delt with.!!! As soon as possible, I will refinance to get away from ASC AND Wells Forgo!!!

I have had the opportunity to speak with many good people. My intentions for the blog was to find their were others out their. Hardworking families that are dealing with a company that is rotten to the core. My advice to all is record you conversations, keep detailed notes and every one that want to band together. I have been contacted by many attorneys that have dealt with ASc and its affiliates. Feel free to continue to contact me . Mr Price and myself are trying to gather names. Please don't call if you are a hater because those calls get old.

I am now taking action against ASC, for mortgage FRAUD. I need every person out there that has experienced harassement, lies, deceit, and pressure form ASC to contact me immediately. I have teamed with fellow borrowers that have been subjected to false payment plans and constant misleading based on the so called loan modification program with the loss mitigation department. I live in virginia, and I plan to drive first to Washington D.C. to enlist the help of both Congressional and Senatoral elected officials. Also, I have found that one of our fellow borrowers has contacted Dateline NBC for our TROUBLED story. Their loan modification is hopeless. I call every week starting in October 2007 until today February 2008. My modification is still incomplete. Was told numerous lies. Luckily I saved the payments they wouldn't accept. The law firm they sent my foreclosure to have been great so far. They are trying to work with me. All I can say is try to get loans from somewhere or talk to the lawyer that they sent your loan to.

I have been dealing with ACS since 11/16/07. I requested ASC to consider my loan for a modification or rate freeze (rate was due to reset 1/2008) I complied with all information they requested. on 12/05/07 I was told and received a letter in the mail that that they would make a decision within 30 days if not sooner. I called several times after that and mid-January i was told they were backed up so not to expect a decision for another 30 days on top of the first 30 days. I called week of 1/21 and ASC and they told me that I was going to be rejected unless I modified the Financial worksheet. I did that that very same day, as I moved foward with debt consolidation. I called and followed up several times after that. On 1/30 I called to make the January payment over the phone and was advised that If I made teh payment I would not be considered for a loan modification (I have name of person), so I didn't make the payment. My CS was 674 at the time. I called in on 2/11/08 and was told that a negotiator had not been assigned. On 2/16 I received a letter from ASC stating that my request was denied by teh Investors as not in their best interest. I have been current all this time. I called 2/18 and after usual ASC phone greeting of "this was in attempt to collect debt" di dI finally speak to a live person. I was told that they were not familiar with teh Loss Mitigation department procedures and they went on to tell me about the ART (ARM Review Team) process. My credit score is now 633 due to the 30 days late reported by ASC at their guidance. Now I'm hoping to qualify for a rate freeze or loan modification to a lower fixed interest rate. I can understand the lady's ordeal since I'm just struggling to be considered. ASC has provided me with over 15 different phone numbers and another 5 fax numbers and they don't know what other departments or sections of their company do!!
